Why this privacy statement?

If you have a NEXXT GYM subscription, want to take out a NEXXT GYM subscription, visit our website out of interest, use our app or respond to our social media communications, we need certain personal information from you. We want to be transparent about the processing of your personal data by NEXXT GYM, hence this privacy statement. It goes without saying that NEXXT GYM treats your personal data with the utmost care and complies with the laws and regulations on the protection of personal data, such as the General Data Protection Ordinance (GTC).

In the following, we have listed for you what data we process about you, what the processing principles are, why we do this and how we handle your personal data. It also explains how you can influence the processing of your personal data by NEXXT GYM.

Because we are a dynamic company in a rapidly developing environment, it is important that we update our privacy statement from time to time. We therefore reserve the right to change this privacy statement at any time. The most current state of affairs can always be found on our website. We therefore advise you to visit this page regularly.

 

What personal data are we processing?

NEXXT GYM processes personal data. According to the AVG, personal data is "any information relating to an identified or identifiable natural person". These are all data that can be traced directly or indirectly to your person. We receive the data directly from you when you become a member of NEXXT GYM, when you visit the website or when you contact us via social media.

 

Data of our members

When entering into a NEXXT GYM subscription, we will in any case process your name, address, place of residence, telephone number and your e-mail address, bank account number, gender and date of birth.

Even if you already have a NEXXT GYM subscription, we will continue to process this type of personal information about you. When using the services of NEXXT GYM, the following personal data will also be processed, depending on which services are purchased: membership number, card number, language choice (country of the studio), which studio you have designated as your home studio, channel you joined, visit registration to studio, last visit to studio, type of subscription, purchased extras, sport profile if survey is completed, information you may have provided to our customer service, your financial status at NEXXT GYM (purchased services and products and whether these have been paid for), any NPS score if you participated in a member satisfaction survey, any data you have entered such as: height, (varying) data about weight, data about registered workouts and data about chosen nutrition.

 

Finally, we have cameras in and around our studios. It is possible that camera images will be made of you. Camera's are of course not in the dressing rooms and we only see the images if necessary and for a limited period of time. We use camera surveillance for our access control and the security of goods and persons present in our studios.

 

Data of our website visitors

Personal data of visitors to our website are also processed. These are personal details that you fill in on the contact page or in the webshop, such as your e-mail address, name, address, place of residence, current location or telephone number.

 

Social media expressions

The data that you enter yourself on social media or that we collect in response to your responses to social media communications will be processed by NEXXT GYM. This may include personal data that you enter yourself on the contact page of the platform in question, such as your e-mail address, name, address, place of residence or telephone number.

 

What are the principles for processing?

We may only process your personal data if there is a legal basis for doing so. There are the following principles:

- When you have given us permission to do so. This permission can be revoked at any time;

- The execution of the agreement you have entered into with NEXXT GYM;

- fulfilling a legal obligation of NEXXT GYM;

- to protect vital interests of yours;

- in the performance of a task in the public interest or in the exercise of public authority; and

- for the protection of the legitimate interests of NEXXT GYM.

For what purpose do we process your data?

 

Service

NEXXT GYM processes your data to provide you with our fitness services. For the creation of a membership card which gives you access to the studios of NEXXT GYM, handling and answering questions and complaints, drawing up, sending and collecting invoices and communicating in the correct language. In addition, we process the data you have entered for specific services.

 

Inform

NEXXT GYM processes your data in order to be able to inform you mainly by e-mail (or in some cases by letter or telephone). You will receive information about your subscription for which you cannot unsubscribe. You will also receive information about similar products and services from NEXXT GYM. You can unsubscribe from these messages at any time.

 

Marketing and sales activities

When you register, we ask you whether you would like to receive information about other types of NEXXT GYM products and services, third party products and services and whether we may use your details to send information specifically targeted to you by means of profiling. If you indicate that you do not wish to receive this information, you will not receive it. You can always unsubscribe from this information and indicate and change your choice. To be clear: we do not sell the personal information of our members to third parties so that they can use that information for their direct marketing activities.

 

Analyses & (market) research

We may use your personal data to conduct research and analysis for the purpose of improving the services of NEXXT GYM and its affiliates. We may also ask you if you would like to participate in a free customer or market survey in order to improve our services. It is up to you to decide whether or not you want to participate by giving your permission.

 

Reporting

NEXXT GYM processes member data for statistical analysis and management reporting. Based on these analyses and reports, decisions are made, products and services are evaluated and campaigns are assessed for effectiveness. Members' data is used for this purpose on an aggregated level. Aggregated means that the data does not contain information about individual members, but only information about certain groups, such as based on usage, age or new members.

 

Contact with member

If you contact us or we contact you by phone, email, social media, chat or in any other way, your details will be registered. In this way NEXXT GYM employees can later see that you have been contacted before and about what. This way we can help you faster and better. Think, for example, of questions about services, complaints, invoices and payments, if you participate in market research and in sales meetings.

Telephone conversations between members and NEXXT GYM can be stored for eavesdropping and for training purposes. If a call is recorded, you will first hear a message that the call can be recorded.

 

Legal obligation

NEXXT GYM may be required by law or regulation to process your personal information and/or to provide it to third parties. For example, if a competent authority such as the police so requests in the context of a criminal investigation.

We do this by, among other things, taking physical and organizational measures for access security, protecting every desktop with a user name and password and authorization management so that your data cannot be viewed by all NEXXT GYM employees. This also includes keeping software up-to-date and regularly testing our security measures.

 

How long do we keep your data?

We will retain your data to the extent necessary to fulfill the purposes for which we process your data and for no longer than is legally permissible. The final retention period differs per type of personal data. If you are a member of NEXXT GYM, we will retain your information. At the end of the storage period, your personal data will be anonymised or deleted.

 

Do we use the services of third parties when processing data?

NEXXT GYM makes use of services of other parties. This takes place only after security and privacy screening and only after the company has signed an agreement regarding the use and protection of personal data. Activities in which third parties are involved are: offering introductory lessons, (online) marketing, market research, debt collection, advertising and advertising effectiveness analysis, web analysis and applications/saas services used in the context of recruitment and selection, member administration, customer service and marketing, mobile app, telephone contacts and bank traffic.

 

Do we provide data to third parties?

In principle, NEXXT GYM does not provide or sell data to third parties. However, NEXXT GYM may be required by law or regulation to process your personal information and/or provide it to third parties. How can you influence the processing of your personal data?

Restriction of processing

You have the right to request and obtain the limitation of a processing in a number of specific cases: during the period of contestation of the accuracy of personal data and the verification thereof, if the processing has turned out to be unlawful but you still do not want the data to be deleted, if NEXXT GYM no longer needs the data but you still need the data for legal action and if you have objected to the processing and are still waiting for the answer to the objection.

 

You request, as it were, that the personal data be marked (temporarily locked) with the aim of restricting the processing in the future.

 

Transferability of data

You have the right to have your data transferred. This allows you to request and receive a copy of your personal data that can be used, for example, at another service provider. The data will be provided in a structured, common and machine-readable form. Think of an Excel file, CSV file or will be downloadable. This right only applies if the processing of the data is based on consent or an agreement and if the processing is carried out via automated procedures.

 

Objection to processing
